Terms & Conditions
Last updated: October 2026
These terms govern every quotation, sample and production order placed with Mingkos
(mingkos.com). Please read them together with our Privacy Policy,
Returns & Refunds and
Shipping & Delivery pages.
1. About us and these terms
Mingkos (“we”, “us”) supplies customised corporate gifts, branded merchandise and printed products to
business customers. By requesting a quotation, approving a proof or placing an order you agree to these terms.
If anything here conflicts with a signed agreement between us, that signed agreement wins.
2. Quotations and prices
- Quotations are valid for 30 days unless stated otherwise, and are based on the quantity, specification and
artwork you gave us at the time. - Prices shown in the online designer are estimates generated from the options you selected. The final price is
confirmed on your proforma invoice after we check your artwork and specification. - Prices exclude taxes, duties and shipping unless the quotation says otherwise.
- Volume pricing is tiered: the unit price falls as quantity rises, and the tier boundaries are shown on each
product page.
3. Orders
An order becomes binding when you approve the proof (or, for straight repeat orders, when you confirm the
invoice) and the deposit is received. Until then we have not committed production capacity to your job.
4. Artwork, intellectual property and brand use
- You confirm that you own, or are licensed to use, every logo, image, font and text you send us, and that
printing it on the products you ordered does not infringe anyone else’s rights. - You indemnify us against claims arising from artwork you supply.
- We use your artwork only to produce your order and to prepare proofs for you. We do not reproduce or publish
it without written permission. - Mock-ups and product photographs we create for your order remain our material; you may use them commercially
once the order is paid for in full.
5. Proofs and approval
We provide a digital mock-up, and where requested a physical sample, before production. Once you approve a
proof, that proof becomes the reference standard for the whole run. Please check spelling, colour references,
placement and sizes carefully at this stage — errors noticed after approval cannot be corrected free of charge.
6. Production and lead times
Lead times start from the later of (a) proof approval and (b) receipt of the deposit. Stated lead times are
working estimates, not guaranteed delivery dates. Where a deadline is critical, tell us in writing before you
order so we can confirm a schedule and, where needed, an expedited option.
7. Shipping, customs and risk
- Risk passes to you when the goods are handed to the carrier, unless we have quoted DDP terms.
- Import duties, taxes and customs clearance are your responsibility unless the quotation states they are
included. - Transit times given by carriers are estimates; we are not liable for carrier delays outside our control.
8. Cancellation and changes
Changes requested before proof approval are free. After production begins, we will quote for any rework and
you may be charged for materials and work already completed. Custom goods cannot be cancelled once personalised,
except where the fault is ours.
9. Defects, returns and refunds
Because every item is personalised, we do not accept returns for change of mind. Defective, damaged or
incorrect goods are remade or refunded — see Returns & Refunds for how to
report a claim and the time limits that apply.
10. Limitation of liability
To the extent permitted by law, our liability for any order is limited to the value of that order. We are not
liable for indirect or consequential loss, lost profit, or delays caused by events beyond our reasonable control.
Minor variations in colour, size and finish within normal production tolerance are not defects.
11. Privacy
How we collect, use and protect your data is described in our
Privacy Policy.
12. Governing law
These terms are governed by the laws agreed in your quotation, or where none is stated, by the laws of the
jurisdiction in which the supplying Mingkos entity is registered. Both parties will try to resolve disputes in
good faith before starting formal proceedings.
